SpringerLinkExklusives Flüchtlingsschutzregime, koloniale „Andere“ und Geschlechterdichotomien - Zeitschrift für Friedens- und KonfliktforschungAlthough international refugee law and protection purports to apply to all people categorized as refugees worldwide, its founding and application is situated in the geopolitical memory of the global powers. This results in conceptualizations of refugees split along a Global North-South divide, which is what this article explores. Drawing on colonial Othering, the article addresses three intertwined areas: international refugee law, political discourses about refugee protection and gendered effects for refugees, especially in postcolonial Africa. We argue that the 1951 Refugee Convention’s focus on refugees in Europe has contributed to the structural neglect and Othering of refugees ‘elsewhere’. This would intensify in political discourses about protection during and after decolonization in Africa; the focus was not on legal asylum but on humanitarian relief. As a result, the ‘Other’ refugees were portrayed as helpless, apolitical and feminine bodies in need of relief, which (re)produced Western gender dualities.
